1. Your agreement to these terms

These Terms of use (the “Terms”) are a legal agreement between you and Sutter Butte Dusters Inc (“Sutter Butte Dusters”, “we”, “us” or “our”). They apply when you use this website, send a form on it, or contact us through it.

When you use this website, you agree to these Terms. If you do not agree, do not use this website.

If you use this website for a farm, company or other organization, you agree to these Terms for that organization. You also confirm that you have the authority to do so.

Our Privacy policy is part of these Terms. It tells you how we collect and use your personal information.

3. Information on this website is not advice

The information on this website is general information. It is not agronomic, pest control, legal, regulatory, tax or aviation advice for your farm or your situation.

• The product label is the law. Read and obey the label of each product. Where the law makes a written recommendation necessary, only a licensed pest control adviser (PCA) can give it.
• Rules change. Permits, restricted materials, buffer zones, notice periods and seasons change, and they are different in each county. Our county and crop pages are summaries only. Before you make a decision, speak to your PCA and your County Agricultural Commissioner.
• Our figures are past results. Figures on this website, for example acres per year, response time, on-time record and drift claims, are averages and past results. They are not a promise of future results.
• Images are examples. Photos and images show the type of work that we do. The aircraft, crop and conditions on your job can be different.

We try to keep this website correct and current. But it can contain errors or old information. We can change, add or remove information at any time, without notice.

4. Requests for work

A request is not a contract

When you send a quote form, call, text or email, you make a request only. A request is not a contract, a booking, or a promise of a price or a date. A job starts only when we confirm it to you. The price is the price in our quote or invoice for that job.

Weather, safety and the law control the schedule

The date and time of each application depend on weather, wind, temperature inversions, field conditions, the product label, permits, county restrictions, and aircraft and pilot availability. We can delay, change or refuse a job when it is necessary for safety or to obey the law. The pilot in command makes the final decision about whether a flight is safe.

Your responsibilities

When you ask us to do work, you agree to:

• Give us information that is true, correct and complete.
• Request work only on land that you own or operate, or where the owner or operator gave you the authority to request it.
• Give us the correct field location and boundaries, and tell us immediately if they change.
• Tell us about hazards and sensitive areas near the field. Examples are homes, schools, roads, workers, livestock, bee hives, waterways, wells, power lines, towers, and organic or sensitive crops.
• Get the permits, recommendations and notices that the law makes your responsibility.
• Keep persons and animals out of the field during the application and during the restricted-entry interval on the label.

The agreement for each job controls

Our quotes, work orders, invoices and other agreements for a job control that job. If one of them is different from these Terms, that document controls the job. These Terms do not change those documents. These Terms apply to this website.

5. Plane-sale requests

When you send the plane-sale form, you ask us to think about a purchase. The form is not an offer to buy, and our reply is not an offer to buy. We make an offer only in writing. You and we can decline at any time before both of us sign a written purchase agreement.

When you send the form, you confirm that you own the aircraft or have the authority to sell it, and that your information is true. A purchase can need an inspection, a title search and a review of the logbooks.

6. Job applications

A job application that you send to us does not make an employment contract or a promise of employment. We use your application as our Privacy policy says.

7. Calls, text messages and email

When you send a form or contact us, you agree that we can call you, send text messages to you and email you about your request or your job. You agree that we can give you notices and documents electronically. An electronic notice has the same effect as a notice on paper.

• We send only text messages about your request or your job. We do not send marketing text messages.
• The number of messages changes with your job. Your mobile carrier can charge you for messages and data.
• To stop text messages, reply STOP. To get help, reply HELP, or call (530) 695-2294.
• You do not have to agree to text messages to get a quote or buy our services.
• Give us only a phone number that is yours, or that you have permission to use. Tell us if your number changes.

8. Rules for the use of this website

You must not:

• Use this website for an unlawful purpose, or in a way that breaks a law or the rights of a different person.
• Send false information, or information about a different person without the permission of that person.
• Send spam, viruses, malware or other harmful code.
• Try to get access to parts of this website that are not public, or test, scan or attack its security, unless you have our written permission.
• Send so many automated requests that the website becomes slow or stops.
• Copy this website to make a different website, or pretend to be Sutter Butte Dusters.
• Use our name, logo or aircraft markings in a way that suggests that we approve you, your business or your products.
• Show this website inside a frame on a different website.

Search engines and AI assistants can read and index the public pages of this website, as our robots.txt file permits. We like it when they quote us with a link.

9. Our content and trademarks

Sutter Butte Dusters Inc or its licensors own the text, photos, images, video, graphics, logos and design of this website. Copyright, trademark and other laws protect them.

You can:

• Look at, download and print pages for your own use or for the internal use of your farm or business.
• Send links to our pages to other persons.
• Quote short parts of our text, if you name Sutter Butte Dusters and give a link to the page.

“Sutter Butte Dusters”, our logo and our aircraft markings are our trademarks. Other names on this website, for example aircraft and equipment brands, belong to their owners. When we use these names, it does not mean that their owners approve us.

This section applies to this website only. The warranties for our application services, if any, are in the agreement for each job and in the law.

13. Limit of liability

This section does not:

• Apply to our application services. The agreement for each job and the law control our liability for those services.
• Limit liability for fraud, for willful injury, for gross negligence, for a violation of law, or for other liability that the law does not let us limit.

14. Your responsibility for claims

You agree to defend Sutter Butte Dusters Inc and its owners, officers, employees, pilots and agents against claims from other persons. You also agree to pay the losses, damages, costs and reasonable attorney fees that come from these claims. This applies to the extent that the claim comes from:

• Your violation of these Terms.
• Information that you sent to us that was false, wrong or incomplete, for example a wrong field location.
• Your violation of a law or of the rights of a different person.

We will tell you about the claim. We can control the defense, and you agree to help us with it. You must not settle a claim against us without our written agreement.

15. Law and courts

The laws of the State of California control these Terms and all disputes about this website. The California rules about conflicts of law do not apply.

Talk to us first. Before you start a legal claim, contact us at info@sutterbuttedusters.com and tell us about the problem. You and we will try to settle it in good faith for 30 days.

Courts. If the problem does not settle, only these courts can hear the dispute: the Superior Court of California, County of Sutter, or the United States District Court for the Eastern District of California. You and we agree to the jurisdiction of these courts.

Small claims. You and we can always take a claim to the small claims court in Sutter County, if the claim is in the limits of that court.

16. End of access

We can stop or limit your access to this website at any time if you break these Terms or the law. The sections about our content, disclaimer of warranties, limit of liability, your responsibility for claims, and law and courts stay in effect after your access stops.

17. Changes to this website and these Terms

We can change, stop or remove any part of this website at any time.

We can change these Terms. When we change them, we put the new Terms on this page and change the date at the top. The changes apply from that date. When you use this website after that date, you agree to the new Terms. A change does not apply to a dispute that started before the change.

18. General terms

• Full agreement. These Terms and our Privacy policy are the full agreement between you and us about this website. They replace all earlier agreements about this website. They do not replace the agreement for a job.
